Petition initiated by two former UN Assistant Secretaries-General, UN Humanitarian Coordinators for Iraq: Hans von Sponeck and Denis Halliday.

On 9 December 2014, the US Senate released its CIA torture report. The investigation confirmed what globally has been known for many years: the US Central Intelligence Agency and US-outsourced national authorities in Europe, the Middle East and elsewhere have been involved in an extensive range of torture applications.

Compelling evidence has become available, especially since 2001, the beginning of the Afghanistan war, through investigations by the European Parliament and national judicial authorities, as well as two major reports presented by Swiss Senator Dick Marty in 2006 and 2007 to the Council of Europe, on secret CIA detention centres in Europe, the Middle East and elsewhere.

The US Senate report makes it clear that cruel, degrading and inhumane treatment of captives by the CIA and its collaborators have been carried out on a continuous basis.

Such treatment can not be justified in any manner, even if the US Government reservations with which it signed the UN torture convention in 1994 were to be taken into account. CIA personnel and others wilfully participated in following executive orders and directives thereby violating the UN torture convention and the Geneva Convention III. In this way they have committed serious crimes for which they must be held accountable.

There's nothing "humanitarian" about a new US/NATO war of aggression.

The Syrian Civilian population has been the major victim of all kinds of violence and they definitely don't need anymore bombing and destruction from the US and NATO.

Every U.S. war claims to “punish” a bad act. After the Tonkin Gulf incident and the Vietnam war, the incubator baby massacre in Kuwait and the first Gulf war, the Racak massacre and the Kosovo war, the Iraqi weapons of mass destruction and the second Gulf war, the threat of massacre in Benghazi and the Libyan war, the alleged use of chemical weapons by Syrian Government Forces is the latest pretext invoked to justify an imminent war.

All the previous pretexts were fabricated or dubious.

What we know is that 12 members of the Syrian rebel forces were arrested in May in Turkey. The rebels possessed 4.5 pounds of Sarin, the neurotoxin gas that allegedly has been used in the recent attack. What we also know is that United Nations Human Rights investigator Carla Del Ponte declared in May: “according to what we have established so far, it is at the moment opponents of the regime who are using sarin gas”.

In 1999, I travelled to Iraq with Denis Halliday who had resigned as assistant Secretary-General of the United Nations rather than enforce a punitive UN embargo on Iraq. Devised and policed by the United States and Britain, the extreme suffering caused by these "sanctions" included, according to Unicef, the deaths of half a million Iraqi infants under the age of five.

Ten years later, in New York, I met the senior British official responsible for the imposition of sanctions. He is Carne Ross, once known in the UN as "Mr.Iraq". I read to him a statement he made to a parliamentary select committee in 2007 : "The weight of evidence clearly indicates that sanctions caused massive human suffering among ordinary Iraqis, particularly children. We, the US and UK governments, were the primary engineers and offenders of sanctions and were well aware of this evidence at the time but we largely ignored it or blamed it on the Saddam government. [We] effectively denied the entire population a means to live." I said, "That's a shocking admission."

"Yes, I agree," he replied, "I feel very ashamed about it... Before I went to New York, I went to the Foreign Office expecting a briefing on the vast piles of weapons that we still thought Iraq possessed, and the desk officer sort of looked at me slightly sheepishly and said, 'Well actually, we don't think there is anything in Iraq.' "

That was 1997, more than five years before George W. Bush and Tony Blair invaded Iraq for reasons they knew were fabricated. The bloodshed they caused, according to recent studies, is greater than that of the Rwanda genocide.

KUALA LUMPUR, 12 April 2012 - The Kuala Lumpur War Crimes Tribunal will be hearing the second charge of Crime of Torture and War Crimes against former U.S. President George W. Bush and his associates namely Richard Cheney, former U.S. Vice President, Donald Rumsfeld, former Defence Secretary, Alberto Gonzales, then Counsel to President Bush, David Addington, then General Counsel to the Vice-President, William Haynes II, then General Counsel to Secretary of Defense, Jay Bybee, then Assistant Attorney General, and John Choon Yoo, former Deputy Assistant Attorney-General. The charge reads as follows:

The Accused persons had committed the Crime of Torture and War Crimes, in that: The Accused persons had wilfully participated in the formulation of executive orders and directives to exclude the applicability of all international conventions and laws, namely the Convention against Torture 1984, Geneva Convention III 1949, Universal Declaration of Human Rights and the United Nations Charter in relation to the war launched by the U.S. and others in Afghanistan (in 2001) and in Iraq (in March 2003); Additionally, and/or on the basis and in furtherance thereof, the Accused persons authorised, or connived in, the commission of acts of torture and cruel, degrading and inhuman treatment against victims in violation of international law, treaties and conventions including the Convention against Torture 1984 and the Geneva Conventions, including Geneva Convention III 1949.

The Kuala Lumpur War Crimes Commission (KLWCC) following the due process of the law is bringing this charge against the accused. In 2009, the Commission, having received complaints from torture victims from Guantanamo and Iraq, proceeded to conduct a painstaking and an in-depth investigation for close to two years. Two charges on war crimes were drawn and filed against the accused persons.

It's official policy, in fact, because the business of America is war, permanent war against humanity by military, financial, political and other means.

As a result, terrorizing and destroying the Libya that was continues, focused heavily on what's called Gaddafi loyalists' last stronghold. No matter the death, destruction and human misery already caused. Or that Tripoli residents are now terrorized by a continuing bloodbath. Anyone believed to be pro-Gaddafi is under threat of death. No matter also that Sirte, a city of 100,000, is being terror bombed relentlessly, perhaps intending to turn it to rubble. It wouldn't be the first time Washington and its Western allies did it. Forced disappearances and missing persons: The missing persons of Iraq. -Always someone’s mother or father, always someone’s child.

A forced disappearance (or enforced disappearance) is defined in Article 2 of the Convention for the Protection of All Persons from Enforced Disappearance, adopted by the United Nations General Assembly On 20 December 2006, as the arrest, detention, abduction or any other form of deprivation of liberty by agents of the State or by persons or groups of persons acting with the authorization, support or acquiescence of the State, followed by a refusal to acknowledge the deprivation of liberty or by concealment of the fate or whereabouts of the disappeared person, which place such a person outside the protection of the law. Often forced disappearance implies murder. The victim in such a case is first abducted, then illegally detained, and often tortured; the victim is then killed, and the body is then hidden. Typically, a murder will be surreptitious, with the corpse disposed of in such a way as to prevent it ever being found, so that the person apparently vanishes. The party committing the murder has deniability, as there is no body to prove that the victim has actually died. [1]

Article 1 of the Convention further states that No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification for enforced disappearance.[2]

Neither Iraq, nor the USA have signed or ratified this convention.[3]

The United States refused to sign, saying that the text "did not meet our expectations", without giving an explanation.[4]

Once again the United States placed itself outside the provisions of International Humanitarian law.

We, the undersigned, defending the right of Iraq to independence, sovereignty, unity and territorial integrity, rejecting the attempts of Iraqi puppets promoted by the US occupation to trade the national rights of Iraqis and to institutionalise via census the criminal demo-graphic engineering they have pursued by force, declare that:

From the first day of the US-UK occupation of Iraq, the occupation began to undertake a series of measures, directly or through its local allies, to destroy Iraq as a state and a nation and to partition it along ethnic and sectarian lines.

Today, the puppet government of the occupation and its Kurdish partners are trying to hold a population census in Kirkuk province whose aim is to give a permanent legal character to the criminal social engineering, ethnic cleansing and demographic changes that have been implemented under occupation.[1] This could unleash a full blown civil war across Iraq, and potentially lead to its partition and a consequent regional war.

In addition to the death of more than one million Iraqis, the ethnic cleansing and other means pursued by the United States, United Kingdom and their allies in order to implement the process of partitioning Iraq, in its cities and regions, have caused the forced migration of 2.5 million Iraqis out of Iraq and the forced displacement of 2.5 million others from their homes inside Iraq.

Part I: “Success”, a devastating balance sheet

In the immediate aftermath of the 2003 invasion, the triumphalist verdict of the mainstream media was that the war had been won; Iraq was assured of a benevolent, democratic future. The Times's writer William Rees-Mogg hymned the victory: "April 9 2003 was Liberty Day for Iraq. (…) It was achieved by "the engine of global liberation", the United States. "After 24 years of oppression, three wars and three weeks of relentless bombing, Baghdad has emerged from an age of darkness. Yesterday was an historic day of liberation."[1]

"The problem with this war for, I think, many Americans is that the premise on which we justified going to war proved not to be valid, that is Saddam having weapons of mass destruction," Defense Secretary Robert Gates told reporters while visiting Iraq.

"So when you start from that standpoint, then figuring out in retrospect how you deal with the war — even if the outcome is a good one from the standpoint of the United States — it will always be clouded by how it began." [2]

So here Robert Gates acknowledges that this war was illegal according to international law, because there was no “casus belli”. But in the same sentence he says that the outcome has been good for the United States. What does he mean exactly? How can all the killing and destruction be a good outcome for the USA? And what about responsibilities? If you know that Iraq is still paying reparations for the invasion in Kuwait in 1990, how about the payment of reparations by the USA for the destruction it inflicted upon Iraq?

"We fought together, we laughed together, and sometimes cried together. We stood side by side and shed blood together," Gen. Ray Odierno told Iraqi military leaders and hundreds of American soldiers and officers during the ceremony that officially closed combat operations."It was for the shared ideals of freedom, liberty, and justice."[3] Yes, they laughed together, like in the infamous, by Wikileaks released video of the “Collateral Murder” helicopter gunship attack on Baghdad civilians in July 2007, that killed more than a dozen Iraqis, two of them journalists of Reuters. And blood they surely have shed together! A lot of blood of over a million mothers, fathers, children and elderly Iraqi people. All that for “shared ideals of freedom, liberty and justice”, Mr. Odierno? Well, most Iraqis don’t share that view. For them, the country has slided into the age of darkness.

First the good.

On June 22, the International Middle East Media Center reported that the UN Human Rights Council (that established the Goldstone Commission) approved "forming an international committee to probe the deadly Israeli" Flotilla attack, massacring and injuring dozens of nonviolent activists on board. Israel's Defense Minister Ehud Barak urged Secretary-General Ban Ki-moon to shelve it, saying:

"We expressed our view that for the time being, as long as....new flotillas are in the preparation, it's probably better to leave (an investigation) on the shelf for a certain time" - in other words, postpone it long enough to forget, letting Israel's self-examination whitewash top officials' culpability, a vain hope given world outrage, mushrooming toward universally branding Israel a pariah rogue state.

The Human Rights Council (HRC) said committee officials will include lawyers and international law and human rights experts, the body to present its findings in September.

The European Campaign Against the Siege said the International Committee will contact Israel, Greece, Turkey, and the Freedom Flotilla coalition. It will also visit Gaza and urge Tel Aviv's cooperation, what wasn't given the Goldstone Commission, nor will be this time. However, with or without it, the investigation will proceed, exposing Israel's culpability.

Israel’s killing of 19 innocents with 60 more injured must have maximal consequences. Israel impunity is a threat to all.

Even for eyes burnt witnessing human suffering, there is something shocking, something impossible, about watching Israeli soldiers, armed and in gas masks, fast-roping from helicopters onto an aid ship filled with civilians — journalists, parliamentarians, human rights activists, mothers, doctors — headed to Gaza to break the inhuman siege that keeps 1.5 million people somewhere between life and death.

The Mavi Marmara, carrying 10,000 tons of humanitarian aid, was flying a white flag: a universal symbol of non-violence. It was also flying the Turkish flag, in international waters, giving it status as a sovereign extension of Turkey. Regardless, Israel attacked. For what does Israel fight? Its existence, or the continuance of a regime of collective punishment calculated to destroy the Palestinians? Or are these the same thing? Dead: 19. Injured: 60. Who gave the order? Will NATO react to an attack on one of its members?
